Terms and conditions
Welcome to the PhysioHub community, a secure online environment for APA members to connect and learn. By joining and participating in the PhysioHub community, you agree to the terms and conditions of this service set out below. If you do not agree with any provision in these terms and conditions, do not use this service.
In these terms and conditions, the expressions "we", "us" and "our" are a reference to Australian Physiotherapy Association (APA).
In these terms and conditions, we may incorporate by reference additional APA policies and guidelines, including the APA Privacy Policy which explains how we collect and use your personal data. Please read all referenced documents carefully to understand your rights and responsibilities when using this service.
Community purpose
The PhysioHub online community is intended to foster collaboration, discussion, and networking among members. The community exists to provide a platform for sharing knowledge, experiences, education and insights related to physiotherapy and the APA membership community.
Eligibility
To participate in the PhysioHub online community, you must be:
- a current member of the APA, an employee of the APA, or be invited by the APA as a verified partner of the APA. The APA reserves the right to invite partners to participate, including but not limited to professional development presenters and third-party partners
- in good standing with the organisation and compliant with the member code of conduct.
Consent for information sharing
By accepting these terms, you consent to the APA sharing your APA membership profile and professional information with other participants of the PhysioHub community for the purposes of the PhysioHub online community.
Respectful engagement
Members must engage in respectful and constructive communication. By participating in this community, you agree not to:
- use disrespectful, offensive, harmful, or inappropriate language (use of any swear word is absolutely unacceptable)
- harass, threaten, or discriminate against others based on race, gender, religion, nationality, or any other status
- post inappropriate or objectionable material.
Inappropriate or objectionable material includes but is not limited to material which:
- is intended to (or could possibly) cause insult, offence, intimidation or humiliation
- is defamatory of or threatening to any person
- is offensive, obscene, criminal, discriminatory, derogatory
- promotes or incites hatred or violence
- is or may be false or misleading
- infringes the rights of, or affects the use and enjoyment of this community by, any person
- could adversely affect the image, reputation, viability or profitability of APA or our business partners or suppliers
- discloses commercially sensitive, anti-competitive, private, or confidential information.
You must not:
- interfere with the proper working of PhysioHub
- circumvent or attempt to circumvent any of the technical measures that we use to manage or secure this community
- use any system or software, manual or automated, to extract data from PhysioHub
- introduce trojans, worms, spyware, or other malicious or technologically harmful content to PhysioHub.
Content guidelines
You are solely responsible for the content you post within the community. This includes, but is not limited to, text, links, images, and files. By posting content, you agree that:
- Your contributions are your own and do not infringe any third-party rights, including intellectual property rights or privacy of any person.
- You grant the community the right to use, reproduce, modify, and distribute your content within the community context.
- Content must remain on-topic and relevant to the community’s goals.
- Any content violating the APAs Professional development advertising guidelines will be removed. Should an individual continue to post content in breach of the APAs guidelines, they may be removed from the community at the APAs discretion
- Any inappropriate or objectionable material or content promoting illegal activity, violence, or hate speech will result in immediate removal and potential suspension of membership.
The APA may remove content, including third-party content and links, or suspend the operation of the community at any time without notice. The APA will not be responsible for any loss, damage or liability that may arise as a result.
Privacy and confidentiality
You must respect the privacy of other members and the confidentiality of shared information. You agree not to:
- share or distribute private messages or confidential information without explicit written permission
- use member contact information for unsolicited marketing or spamming.
Privacy, data collection and use
APA may collect your personal information when you use the PhysioHub community and from your interactions within the community. Your personal data will be handled by APA in accordance with the APA Privacy Policy. You acknowledge and agree that you have been made aware of the matters set out in the APA Privacy Policy. Third-party links and content
The community may include links to third-party websites or content. This includes links to social media, video-sharing websites and web feed services, including but not limited to: Facebook, Instagram and YouTube.
Our links with linked websites should not be construed as an endorsement, approval or recommendation by the APA of the owners or operators of those linked websites, or of any information, graphics, materials, products or services referred to or contained on those linked websites.
While we take reasonable care in linking to other websites, the APA is not responsible for the content, policies, or practices of these third-party sites. The APA is not responsible for the content on those websites. You must exercise your own judgement when you follow a website link to another website, including by reading its terms and privacy policy before you use it.
Moderation and enforcement
The community is monitored by moderators who may:
- remove or delete any content for any reason including that the content breaches or may potentially breach these terms and conditions
- issue warnings, suspend, or revoke community access for violations
- enforce any additional guidelines or rules specific to particular forums or discussions.
The moderators of PhysioHub act as facilitators to help maintain a positive, respectful, and productive environment. However, the APA and its moderators do not assume responsibility for the content posted by community members. By participating, you acknowledge and agree that:
- Moderators nor the APA are liable for any unlawful, offensive, inappropriate or objectionable material posted by others in the community.
- While moderators will make reasonable efforts to monitor and address rule violations, the APA is not responsible for failing to take immediate action on content that violates these terms.
- Any actions taken by moderators, including content removal, warnings, or suspensions, are at the discretion of the APA and are not subject to appeal. The APA is not liable for any perceived harm or loss resulting from such actions.
Copyright and trademarks
By posting content on the PhysioHub community, you grant the APA a non-exclusive, perpetual, royalty-free, worldwide licence to host, display, process, transfer and distribute such content.
All content on the PhysioHub community including text, graphics, logos, icons, sound recordings and software, but excluding user-submitted content, is owned or licensed by the APA. Information procured from a third party may be the subject of copyright owned by that third party.
Other than for the purposes of, and subject to the conditions prescribed under, the Copyright Act 1968 (Cth) and similar legislation which applies in your location, and except as expressly authorised by these terms and conditions, you may not in any form or by any means adapt, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of the PhysioHub community without our written permission or, in the case of third party material, from the owner of the copyright in that material.
Except where otherwise specified, any word or device to which is attached the ™ or ® symbol is a trademark and is proprietary to its respective owner.
Warning
The APA does not guarantee the accuracy, completeness, or quality of content shared within the community and is not responsible for any decisions or actions taken based on community discussions. To the maximum extent permitted by law, the APA is not liable to you or to any other person for any malicious content transmitted through your access or use of the PhysioHub community. You must take your own precautions to ensure that your browser is equipped with updated virus protection software and that you take reasonable precautions to ensure that any materials you download do not expose you to the risk of viruses, malicious computer code or other forms of interference, corruption or damage to your software, hardware or data, or that of any other person.
Termination of access
The APA reserves the right to terminate or suspend your access to the community at any time, with or without cause, including but not limited to any breach or suspected breach of these terms.
Limitation of liability
You acknowledge and agree that you are responsible for and will bear any and all risks associated with your use of the PhysioHub community, and that APA makes no guarantee as to the outcome of this service to you.
The APA is not liable for any direct, indirect, incidental, or consequential loss or damages (including loss of revenue, profits or business opportunity), however caused (including through negligence), which may be suffered or incurred by any person arising
out of your use or inability to use the PhysioHub community or any linked web site, nor do we accept any responsibility for any such loss or damage arising out of your use of or reliance on information contained on or accessed through this service. Members use the community at their own risk.
Nothing in these terms and conditions is intended or is to be construed as excluding or modifying any guarantees, warranties or conditions which are applicable by virtue of the Competition and Consumer Act 2010 (Cth) unless permitted by that legislation. However, our liability for any breach of guarantee, condition or warranty, will be limited, to the extent permitted by law, to the supply of the services again or the payment of the cost of having the services supplied again.
Applicable law
The laws of Victoria, Australia, govern these terms of use. You submit to the exclusive jurisdiction of the Victorian courts to resolve any disputes that may arise in connection with them.
Amendments to terms
The APA reserves the right to modify these terms and conditions from time to time, in our sole discretion, and such modification will be effective immediately upon its posting on our website. You will be notified of any significant changes, and you agree to be bound by any changes to these terms and conditions if you continue to participate in the community after the changes have been implemented. If you do not agree to the changes, you must discontinue and opt out of this service by withdrawing your consent via the APA website and adjusting your privacy settings.
General
If any of these terms of use are held to be invalid or unenforceable for any reason, then the remaining terms and conditions will continue to apply.
The APA may decide not to exercise or enforce any of our rights under these terms of use. If the APA decide not to exercise or enforce any right, or if we do it once, it does not mean the APA waive our rights on any other occasion.
